Health law

This axis will address the protection of the person in its physical dimension. In French law, the norms protecting bodily integrity have a public order scope that limits the right of individuals to dispose of their bodies. As a result, there are points of convergence but also of tension between the values of dignity, freedom and solidarity that constitute the pillars of bioethics. Through issues arising from other axes of the team (dependence, end of life, use of elements of the human body), the researchers of this axis will reinforce their cooperation with the human sciences and ethics.

This axis takes as its object the protection of the person in his physical dimension when he is exposed to risks of mistreatment or abuse of power linked to his situation of vulnerability (old age, cognitive disorder, psychiatric illness). The production of axis 5 will be organized around the problems addressed by other axes of the team, such as situations of dependence, the end of life in medico-social establishments, geriatric services or at home, the manipulation of elements of the human body or products derived from the human body. The researchers in this area will create special links with area 1 on "The body at the extreme ages of life", and area 2 on "Approaches to the elements of the human body in law, bioethics and dentistry". The work carried out in common with the researchers of axis 3 will continue according to the same dynamics as in the previous contract, by analyzing the redeployment of norms caused by health crises. Links with the BONES team are envisaged around the notion of evidence in the context of forensic science.

Projets

Hospital law can be described as the second marker of the team's disciplinary visibility. The books and manuals on this subject have been particularly praised. In recent years, hospital law has given rise to reflections on the organization of the health care system, on financing mechanisms and on liability. In the last few months, the subject has been in full mutation and the team has been able to take advantage of it to propose innovative publications.

Traditional medicine is probably the most surprising object of study. In the West, work on it is, to say the least, scarce. This lack of research does not mean that traditional medicine is not of interest to the researcher or the professional. The emergence of new medical techniques and the demands for a more alternative medicine have raised many legal questions.
